Bassett Decision re Jurisdiction, May 9, 2012, This decision is the first to apply the Supreme Court of Canada decision in NIL/TU,O v. BCGEU, 2010 SCC 45 in the individual employment context. The Adjudicator agreed with the employer that he did not have jurisdiction under the Canada Labour Code to hear a complaint of unjust dismissal brought against a First Nation health organization. Devlin Gailus was counsel for the First Nation health organization.
